General terms and conditions of Kunsthalle Praha membership
Kunsthalle Praha is a space for art and culture located in the former Zenger Electrical Substation building in the historical centre of Prague. It offers visitors a varied programme of exhibitions, educational projects, cultural events and social activities.
The mission of Kunsthalle Praha is to contribute to a deeper understanding of Czech and international art of the 20th and 21st centuries and to reach out to a wide audience with a lively, up-to-date programme. Kunsthalle Praha aims to create a cultural institution that prides itself on expertise and open collaboration, a space that integrates art and cultural experiences into everyday life.
These terms and conditions govern the rights and obligations of you as a member under the Membership and us as the provider of the services you may use under the Membership.

1. Definitions
1.1. Membership is the membership program of the Kunsthalle Praha gallery located at Klárov 132/5, 118 00, Prague 1, which provides its members with a number of benefits described in more detail below;
1.2. We (and/or us, our, etc.) are Kunsthalle Praha, an endowment fund, with its registered office at Evropská 2758/11 Praha 6 - Dejvice 160 00, ID No.: 04535871, registered in the Commercial Register maintained by the Municipal Court in Prague under no. N 1290, e-mail: membership@kunsthallepraha.org;
1.3. Online Membership Purchase means the purchase of Membership through the web interface at www.kunsthallepraha.org;
1.4. Fee is the fee for the Kunsthalle Praha Membership in the amount depending on the type of Membership specified in Sec. 4 below and at kunsthallepraha.org/stante-se-clenem;
1.5. Application Form is your proposal to conclude the Membership Purchase Contract, to be completed online via the website www.kunsthallepraha.org or physically at the Kunsthalle Praha building;
1.6. Contract is a contract entered into on the basis of a duly completed Application Form via the website www.kunsthallepraha.org or physically at the Kunsthalle Praha building, and is concluded as of
a) the date of completing the Application Form and the subsequent payment of the Fee if the purchase of the Membership was made in person directly at the Kunsthalle Praha building;
b) the date on which you receive an email confirmation from us acknowledging receipt of payment of the Fee into our account in the case of an Online Membership Purchase;
c) the date on which the membership gift voucher is exchanged for a physical or virtual membership card.
2. General provisions and instructions
2.1. These Terms and Conditions apply to Memberships purchased online as well as to Memberships purchased physically at the Kunsthalle Praha building.
2.2. When purchasing a Membership, it is your responsibility to provide us with all information correctly and truthfully. We will consider the information you provide to us when you order your Membership to be true and correct. You shall notify us of any change to this information by email at membership@kunsthallepraha.org.
2.3. We reserve the right to modify, replace or cancel the content of the Membership benefits. We will inform you of such changes on our website or by email.
2.4. Membership is associated with the name of the member and is not transferable to another person. Kunsthalle Praha reserves the right to check the identity of the holder of the membership card presented.
2.5. Except as otherwise stated herein, the Membership Fee is non-refundable.
3. Origin and term of membership
3.1. Membership is established as at
a) the date of completing the Application Form and subsequent payment of the Fee in case the purchase of the Membership was made in person directly at the Kunsthalle Praha building,
b) the date on which you receive an email confirmation from us confirming receipt of payment of the Fee into our account in the case of an Online Membership Purchase,
c) the date on which a membership gift voucher is exchanged for a physical or virtual membership card.
3.2. Membership is valid for 12 calendar months from the date of its creation. If the offer includes a deferred validity option, such Membership is valid for 12 calendar months from the date selected, provided that the Fee has been paid in full in advance.
3.3. Membership can be donated to a third party. The donor purchases (online or in person at the Kunsthalle Praha building) a gift voucher for the selected membership category, which the donee exchanges (online or in person at the Kunsthalle Praha building) for a physical or virtual membership card. The exchange must be made within 12 months from the date of purchase of the gift voucher.
3.4. Before your Membership expires, we will send you an email notification of the impending expiration. If the Membership is not renewed by payment of the Fee, it will automatically expire on the last day of validity. Upon expiration of the Membership, eligibility for the benefits associated with the Membership will cease.
3.5. We reserve the right to cancel your membership if your behaviour causes upset to other Members or visitors of Kunsthalle Praha, its employees, sponsors or supporters.
4. Membership types and fees

Junior (15-26)* (benefits for one Member) - free
*Can be purchased at any time before the 26th birthday and will be valid for 1 year regardless of whether the holder reaches the age of 26 during the membership period. -
Senior (65+)** - CZK 400
**For members receiving a statutory pension under the age of 65, a certificate of retirement is required. -
Friends (benefits for a Member and 1 guest, free entry for 1 year for the Member + their 4 guests, extra benefits compared to the "Double" membership in the form of educational and accompanying events) – CZK 3,000

Corporate Partnership - a tailor-made benefits package for legal persons
4.1. Except for corporate partnerships, only natural persons who have reached the age of 15 years may become members.
4.2. For Junior and Senior Memberships, the member must present proof of age when visiting Kunsthalle Praha.
4.3. We reserve the right to change the Fees for each type of Membership once a year. Such a change will not apply to Memberships already purchased.
5. Benefits associated with Kunsthalle Praha membership
5.1. All members will be issued a physical or virtual membership card confirming their Membership. For Membership purchased online, a virtual card will be sent to your email address immediately after payment of the Fee. In the case of Membership purchased in person at the Kunsthalle Praha building, a physical membership card will be issued to you on site while you wait.
5.2. As a member you can use:

unlimited access to all exhibitions and the Kunsthalle Café,

access to exhibition previews according to the programme of Kunsthalle Praha,

entry during extra opening hours,

access to guided tours of exhibitions according to the programme of Kunsthalle Praha,
-
10% discount on goods at the Kunsthalle Design Shop located in the Kunsthalle Praha gallery.
5.3. Based on the Contract, Members are informed about the benefits of membership and the Kunsthalle Praha programme (events) in the newsletter, which is sent to their email provided in the Application Form. Members are recommended to check their spam folders and SPAM, or save the email membership@kunsthallepraha.org to their contact list.
6. Cancellation of the contract for the purchase of membership online
6.1. In the case of an Online Membership Purchase, you have the right to cancel the Contract (Czech: „odstoupit od smlouvy“) without giving any reason within 14 days from the date of its conclusion. You may cancel the Contract by any demonstrable means (in particular, by sending an email or letter to our address set out in Sec. 1.2 of the T&Cs). For cancellation, you may also use the sample form provided by us, which is attached as Schedule 1 to the Terms and Conditions.
6.2. The deadline for cancellation pursuant to Sec. 6.1 of the T&Cs shall be deemed to have been complied with if you send us a notice that you wish to cancel the Contract during that period.
6.3. If the Contract is cancelled, the Fee will be refunded within 14 days of the effective date of cancellation to the bank account from which it was transferred or to the bank account notified in the cancelation notice.
7. Complaints
7.1. If you are not issued a physical or virtual membership card within the time limits specified in Sec. 5.1, you are obliged to notify us immediately in writing at our email address or in person at the Kunsthalle Praha gallery office. In the event of a delay of more than 24 hours in issuing the card, you are entitled to a pro-rata discount on the Fee. You are not entitled to a discount if the physical or virtual membership card has not been delivered to you for reasons attributable to you (e.g. a full email inbox).
7.2. Furthermore, in the event of a failure to provide a discount at the Kunsthalle Design Shop, you have the right to complain immediately at the Kunsthalle Praha gallery office.
7.3. If you are a consumer, upon receipt of a complaint, we will confirm in writing that we have received the complaint, the date of receipt and content thereof, the method of complaint handling you require and the expected duration of the complaint handling. We will decide on the complaint immediately or, in complex cases, within three days of receipt. We will resolve the complaint, including rectification of the defect, if any, without undue delay, but not later than 30 days of its submission. This time limit may be extended by mutual agreement.
7.4. We will inform you about the settlement of the complaint by e-mail or in person if settled promptly at the Kunsthalle Praha office. After the complaint has been settled, we will issue you a written confirmation of the date and manner in which the complaint was settled. If we reject your complaint, we will present you with a written justification for the rejection of the complaint.
7.5. If the complaint is justified, you are entitled to reimbursement of the costs reasonably incurred. Such costs must be documented.
8. Resolving consumer disputes
8.1. If you are a consumer, according to the Consumer Protection Act you have the right to an out-of-court settlement of any consumer dispute arising from or in connection with the Contract. To exercise this right, you are entitled to contact the Czech Trade Inspection Authority, Central Inspectorate - ADR Department, Štěpánská 15, 120 00 Prague 2, e-mail: adr@coi.cz, web: adr.coi.cz. The out-of-court settlement of a consumer dispute is initiated exclusively at your request if the dispute has not been resolved directly with us. The petition may be filed within 1 year from the date on which you first exercised with us your right which is the subject of the dispute.
8.2. Furthermore, you have the right to initiate out-of-court dispute resolution online via the ODR platform available at ec.europa.eu/consumers/odr/.
9. Final provisions
9.1. If our legal relationship contains an international element, the relationship will always be governed by the law of the Czech Republic. However, if you are a consumer, your rights under the laws of your home country are not affected hereby.
9.2. All written correspondence with you will be delivered by email. Our email address is provided under our identification details in Sec. 1.2 of the T&Cs. We will deliver any correspondence to your email address provided in the Application Form, User Account or, where applicable, to any other address through which you have contacted us and which you provide to us.
9.3. In the event of force majeure or events that cannot be foreseen (natural disaster, pandemic, service failures, subcontractor failures, etc.), we shall not be liable for damages caused as a result of or in connection with cases of force majeure, and if the event of force majeure lasts for more than 10 days, we and you have the right to cancel the Contract.
9.4. A sample form to be used to cancel the Contract is attached as a schedule hereto.
9.5. These Terms and Conditions take effect on 1 December 2021.
